The Buyer’s first name, surname, telephone number, email address, delivery address, and billing information, if applicable, consist of the information provided by the Buyer when placing the order.

The Buyer acknowledges that the information provided during the ordering process is accurate and complete. The Seller shall not be held liable for any failure or delay in delivery resulting from incorrect or incomplete information provided by the Buyer.

The following information regarding the products subject to the order is presented to the Buyer on the order summary and payment page:

• Name and essential characteristics,
• Type and variety,
• Quantity,
• Unit sale price,
• Any applicable discount amount,
• Total sale price, including taxes,
• Shipping or delivery charges,
• Payment method,
• Delivery address and method of delivery.

The essential characteristics, ingredients, allergen warnings, net quantity, storage conditions, and instructions for use or consumption are provided on the relevant product page and product packaging.

If the Buyer has any allergies or special dietary requirements, the Buyer is responsible for reviewing the product’s ingredients and allergen information before placing an order. The products may contain dates, milk and dairy products, cocoa, chocolate, coffee, coconut, pistachios, almonds, hazelnuts, and similar ingredients. There may also be a risk of cross-contact with other allergens in the production environment.

Product images may differ slightly from the delivered product due to lighting conditions during photography, screen settings, the natural characteristics of the products, and variations in production. Such differences shall not be considered defects provided that they do not alter the essential characteristics of the product.

The total amount payable by the Buyer, including the product price, taxes, any applicable shipping charges, additional service fees, and discounts, is clearly displayed on the payment page before the order is completed.

Payment shall be made using one of the payment methods offered on the website during the ordering process. Payments made by credit or debit card are processed through the secure payment infrastructure of the contracted payment service provider.

The Seller does not directly store the Buyer’s complete credit or debit card information.

If payment by bank transfer/EFT is offered, the order shall be processed only after the payment has been received in full in the Seller’s account. If payment is not made within the specified period, the order may be cancelled.

The order shall be shipped to the delivery address provided by the Buyer during the ordering process through the contracted courier or delivery company.

Unless otherwise stated on the order page, delivery costs shall be borne by the Buyer. Free-shipping campaigns or delivery options covered by the Seller shall be displayed separately on the order page.

Orders shall be prepared as soon as reasonably possible, taking stock availability and operational conditions into account, and shall in all cases be delivered within the maximum statutory period. For the sale of goods, this period shall not exceed thirty days from the date on which the order is received by the Seller.

The delivery period may vary depending on the Buyer’s location, the courier company’s operating conditions, public holidays, promotional periods, and circumstances of force majeure.

The Seller shall not be held liable for delays resulting from the Buyer’s absence from the delivery address, the provision of incorrect address or contact information, or the courier company’s inability to reach the Buyer.

If it becomes impossible to supply the ordered product, the Seller shall notify the Buyer in writing or through a durable medium and refund the amount collected within the period prescribed by applicable legislation.

The Buyer is advised to inspect the shipping package before accepting delivery.

Where possible, packages that are crushed, torn, opened, wet, spoiled, or clearly show signs of damage to their contents should not be accepted, and the Buyer should request that the courier prepare a damage assessment report.

Any missing, damaged, incorrect, or defective products discovered after delivery should be reported to the Seller as soon as possible, together with photographs and the relevant order information.

For products that do not fall within any of the exceptions to the right of withdrawal, the Buyer has the right to withdraw from the contract within fourteen days from the date of receipt of the product, without providing any reason and without incurring any penalty.

If a product consisting of multiple parts is delivered on different dates, the withdrawal period shall commence on the date the final part is delivered.

To exercise the right of withdrawal, it is sufficient for the Buyer to provide the Seller with an explicit notice within the fourteen-day period.

The withdrawal notice must clearly state the Buyer’s first name and surname, order number, contact information, the product subject to the withdrawal, and the Buyer’s request.

The right of withdrawal may not be exercised in the circumstances specified by applicable legislation. These circumstances include, in particular:

• Products prepared specifically in accordance with the Buyer’s requests or personal needs,
• Products that may deteriorate rapidly or whose expiration date may pass,
• Products whose packaging, tape, seal, wrapping, or protective elements have been opened after delivery and whose return is unsuitable for health or hygiene reasons,
• Products that, after delivery, become mixed with other products and cannot, by their nature, be separated.

The fact that a product is a food product does not, by itself, mean that the right of withdrawal does not apply. Whether the right of withdrawal may be exercised shall be determined by considering the nature and perishability of the product, its expiration date, whether its packaging or protective seal has been opened, and the applicable health and hygiene requirements.

Food products whose packaging or protective seal has been opened, that have been partially consumed, that have not been stored under the required conditions, or that are unsuitable for resale for health or hygiene reasons cannot be returned.

The Buyer’s statutory rights concerning defective, spoiled, damaged, incorrect, or incomplete products remain reserved.

The Buyer who exercises the right of withdrawal must return the product to the Seller, together with its invoice and all complementary parts, if any, within the period prescribed by applicable legislation, commencing on the date the withdrawal notice is submitted to the Seller.

The product to be returned must be unused, unconsumed, undamaged, and in a condition suitable for resale. To the extent possible, the product should be returned in its original packaging and packed in a manner that prevents damage during transportation.

The designated carrier and return address may be communicated to the Buyer after the withdrawal request has been received. Any additional costs resulting from the Buyer’s choice of a carrier other than the return method specified by the Seller may be borne by the Buyer.

Once the product has been received by the Seller, it shall be inspected to determine whether it complies with the applicable return conditions.

If the right of withdrawal is validly exercised, the Seller shall refund the payments collected and required to be reimbursed within the period prescribed by applicable legislation, commencing on the date the withdrawal notice is received, using a payment method consistent with the method originally used by the Buyer.

The time required for refunds made to a credit or debit card to appear in the Buyer’s account may vary depending on the processing times of the relevant bank or payment service provider. The Seller shall not be held liable for any part of this period attributable to the bank or payment service provider.

If the returned product has diminished in value due to use, storage, or transportation conditions attributable to the Buyer, the applicable provisions of legislation shall apply.

If the Buyer receives a defective, spoiled, damaged, incomplete, or incorrect product, the Buyer may exercise the rights granted under Law No. 6502 on Consumer Protection.

To facilitate a prompt assessment, the Buyer should provide the Seller with the following information:

• Order number,
• Description of the issue,
• Photographs of the product and its packaging,
• Batch/lot number and the expiration date or best-before date, if available.

If the product is believed to be unsafe, spoiled, or to have compromised packaging integrity, it should not be consumed, and the Seller should be contacted.

Requests shall be reviewed as soon as reasonably possible, depending on their nature.

In the event of any dispute arising from this Preliminary Information Form or the distance sales transaction, the Buyer may apply to the Consumer Arbitration Committee or the Consumer Court located at the Buyer’s place of residence or at the place where the consumer transaction was carried out, subject to the monetary limits prescribed by law.

Where mandatory mediation is a prerequisite for initiating legal proceedings, the applicable statutory procedures shall be followed.

The Buyer’s personal data may be processed for the purposes of receiving and processing the order, completing payment, delivering the product, issuing invoices, providing customer service, and fulfilling legal obligations.

Detailed information concerning the processing of personal data is provided in the Privacy Policy and KVKK Disclosure Notice published on the website.

The Buyer acknowledges having been clearly, comprehensibly, and legibly informed, before placing the order, about the essential characteristics of the products, the Seller’s contact information, the total sale price, payment and delivery conditions, the right of withdrawal, the circumstances in which the right of withdrawal may not be exercised, the return process, and the available methods for resolving disputes.

The Buyer acknowledges being aware that confirming the order will create an obligation to make payment.

This Preliminary Information Form, together with the order-specific information, constitutes an integral part of the Distance Sales Agreement.

In the event of a dispute, the parties’ electronic records, order information, payment records, email correspondence, delivery documents, and other legally admissible evidence shall be evaluated in accordance with applicable legislation.

This provision does not limit the consumer’s statutory rights concerning evidence, claims, or legal remedies.

The Buyer acknowledges having been informed, before completing the order, about the essential characteristics of the products, the total sale price, taxes, shipping charges, payment method, delivery, right of withdrawal, return conditions, and the Seller’s contact information.

The Buyer becomes a party to this Agreement by reading and electronically approving the Preliminary Information Form and this Distance Sales Agreement and completing the order.

The order-specific product, price, payment, and delivery information, together with the order summary and the Preliminary Information Form, constitute an integral part of this Agreement.
